Terms & Conditions

These Terms & Conditions govern access to the JetsFly website, quotations, communications, bookings, and private aviation services arranged through JetsFly.com Global OÜ. By using the website, requesting a quotation, or booking services, the customer agrees to these terms.

1. Introduction

These Terms & Conditions (the "Terms") govern access to and use of the JetsFly website, all quotations and communications, and all private aviation services arranged through JetsFly.com Global OÜ ("JetsFly", "we", "us"). By using the website, requesting a quotation, or booking services, the customer ("Customer", "you") agrees to be bound by these Terms. If you do not agree, you must not use the website or our services.

3. Definitions

"Operator" means the independent, licensed air carrier holding the Air Operator Certificate under which a flight is performed. "Charter Agreement" means the contract for a specific flight or itinerary confirmed in writing. "Empty Leg" means a discounted repositioning flight dependent on a primary charter. "Force Majeure" means events beyond reasonable control, including weather, air-traffic restrictions, strikes, government action, war, epidemic, or natural disaster. "FBO" means the private terminal handling a flight.

4. Role of JetsFly

JetsFly acts as a private aviation marketplace, charter broker, and booking facilitator. Unless expressly stated in writing, JetsFly does not own, operate, maintain, or crew aircraft. All flights are performed by independent Operators holding the required certificates, licences, and insurance. The contract of carriage is between the Customer and the Operator; JetsFly arranges and facilitates that contract as agent. Nothing in these Terms creates a partnership, joint venture, or employment relationship between JetsFly and any Operator.

5. Eligibility

Customers must be at least 18 years old and legally capable of entering binding contracts. The person making a booking confirms that they are authorised to act on behalf of all passengers in the party, and that all information supplied for those passengers is accurate and complete.

6. Quotations

Quotations may be instant, request-based, or custom. A quotation is an invitation to book, not a confirmed reservation: aircraft remain subject to availability until a booking is confirmed. Quotations are valid only for the period stated on them (or, where none is stated, 48 hours) and may be withdrawn or revised if operator pricing, positioning, fuel costs, or availability change before confirmation.

7. Booking Confirmation

A booking is confirmed only when: (a) aircraft availability is verified with the Operator; (b) required passenger information is provided; (c) payment terms are satisfied; (d) the Operator accepts the booking; and (e) JetsFly issues written confirmation. Until all conditions are met, no booking exists and no aircraft is reserved.

8. Pricing

Pricing depends on aircraft type, route, airport fees, fuel, crew, positioning, permits, seasonality, and operator availability. Unless stated otherwise, confirmed prices are all-inclusive of the items listed on the quotation. Prices are quoted in the currency stated on the quotation; where currency conversion applies, the Customer's payment provider may apply its own rates and fees.

9. Additional Charges

Additional charges may apply for de-icing, premium catering, ground transportation, crew overnight costs, international permits, unusual airport fees, itinerary changes, pets, extra waiting time, additional flight time caused by weather or air-traffic routing, or oversized baggage. Where reasonably foreseeable, such items are included in the quotation; where they arise during performance, they are invoiced after the flight with supporting documentation.

10. Payment

Unless agreed otherwise in writing, full payment must be received in cleared funds before departure. JetsFly may accept bank transfer, cards, approved payment providers, or other methods offered by JetsFly. Late or failed payment may lead to cancellation of the booking and application of the cancellation terms in Section 14. Bank charges imposed by the Customer's institution are for the Customer's account.

11. Passenger Documents & Responsibilities

Passengers must provide accurate information; hold valid passports, visas, and any required health documentation for all countries on the itinerary; comply with immigration, customs, and security rules; arrive at the FBO by the agreed time; and follow crew and airport instructions. Denied boarding, refused entry, fines, or delays resulting from missing or invalid documents are the Customer's responsibility, and no refund is due where a flight cannot be performed for such reasons.

12. Baggage & Dangerous Goods

Baggage allowances depend on the aircraft type and are stated at booking. The Operator may refuse baggage exceeding the agreed volume or weight where carriage would compromise safety or performance. Dangerous goods (including but not limited to flammable liquids, weapons without required permits, and certain lithium batteries) may not be carried except with prior written approval of the Operator and in accordance with applicable regulations.

13. Customer Changes

Changes to confirmed bookings, including dates, times, routing, passenger numbers, or catering, are subject to Operator approval, aircraft availability, airport slots, regulatory requirements, and operational feasibility. Additional charges may apply. Changes are effective only once confirmed by JetsFly in writing.

14. Customer Cancellation

Cancellation charges depend on the Operator's policy stated on the Charter Agreement, the time remaining before departure, costs already incurred, aircraft positioning, and crew scheduling. As is market practice, charges typically increase as departure approaches and may reach 100% of the charter price for cancellations close to departure or no-shows. Refunds, where due, are made after deduction of applicable fees to the original payment method.

15. Operator Cancellation & Delays

Flights may be delayed or cancelled for weather, safety, technical issues, crew duty limits, airport restrictions, government action, security concerns, or Force Majeure. Safety decisions rest solely with the Operator and pilot-in-command. Where a flight is cancelled by the Operator, JetsFly will use reasonable efforts to arrange a substitute aircraft of equivalent or higher category; where no acceptable alternative is available, amounts paid for the unperformed flight are refunded. Delay or cancellation for the causes above does not entitle the Customer to consequential damages.

16. Aircraft & Operator Substitution

Where operationally necessary, JetsFly or the Operator may substitute the aircraft or Operator with one of equivalent or higher category and comparable specification. Material downgrades require the Customer's consent and, where accepted, a corresponding price adjustment.

17. Empty Leg Flights

Empty Leg flights are discounted repositioning flights dependent on a primary charter. Their schedule, routing, and aircraft may change, and the flight may be cancelled entirely, if the primary itinerary changes. In case of cancellation of an Empty Leg by the Operator, amounts paid are refunded; alternative transport is not guaranteed and re-booking at the discounted rate is not assured. Empty Leg bookings may carry stricter payment and cancellation terms, stated at booking.

18. Pets

Pets are carried subject to Operator approval and applicable veterinary and import rules on the itinerary. The Customer is responsible for providing valid animal documentation and complying with destination requirements. Cleaning or damage costs attributable to an animal may be charged.

19. Conduct Onboard

Passengers must comply with crew instructions and applicable law. Smoking is prohibited unless the Operator expressly permits it. The pilot-in-command may refuse carriage, divert, or terminate a flight where passenger conduct endangers safety or violates the law; resulting costs are the Customer's responsibility. Our Passenger Conduct Policy forms part of these Terms.

20. Catering & Third-Party Services

Catering, ground transport, and other third-party services arranged by JetsFly are provided by independent suppliers. JetsFly exercises reasonable care in selecting suppliers but is not liable for supplier acts or omissions beyond its reasonable control. Allergy information should be communicated at booking.

21. Insurance

Operators maintain aviation liability insurance as required by applicable regulation. Carriage is subject to the liability regimes of applicable international conventions (including the Montreal Convention where it applies). Customers are advised to hold their own travel insurance covering cancellation, medical costs, and personal effects.

22. Liability

To the maximum extent permitted by law: (a) JetsFly acts as an intermediary and is not liable for the acts or omissions of Operators or other third parties; (b) JetsFly is not liable for indirect or consequential losses, missed connections, lost profit, business interruption, or accommodation costs; and (c) JetsFly's aggregate liability arising from any booking shall not exceed the fees received by JetsFly for that booking. Nothing in these Terms excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence.

23. Force Majeure

Neither JetsFly nor the Operator is liable for failure or delay in performance caused by Force Majeure. Where Force Majeure prevents performance, the parties will cooperate in good faith to reschedule, and refunds for unperformed services will be handled in accordance with Sections 14–15 and the Charter Agreement.

24. Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law, including the GDPR. Passenger data is shared with Operators, handlers, and authorities strictly as required to perform the services and satisfy legal obligations.

25. Intellectual Property & Website Use

The JetsFly name, logo, website design, and content are the property of JetsFly.com Global OÜ or its licensors and may not be reproduced without written consent. The website is provided "as is"; aircraft images and specifications are illustrative, and while we keep information current, we do not warrant that all content is error-free. Automated scraping of the website is prohibited.

26. Complaints

Complaints should be sent to info@jetsfly.com and will be acknowledged within 2 business days. We aim to provide a substantive response within 14 days. Our Complaints Policy describes the procedure in detail. Nothing in this section limits the Customer's statutory rights.

27. Severability, Assignment & Entire Agreement

If any provision of these Terms is held invalid, the remainder continues in force. The Customer may not assign a booking without JetsFly's written consent. These Terms, the quotation, the written confirmation, and any Charter Agreement constitute the entire agreement for the relevant booking and supersede prior discussions. JetsFly may update these Terms from time to time; the version in force at the time of booking applies to that booking.

28. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. Disputes are subject to the exclusive jurisdiction of the competent courts of Estonia, unless mandatory consumer-protection law of the Customer's country of residence provides otherwise.
